These Terms of Use ("Terms") are an agreement between you and Sewer Cleaning Company LLC, an Ohio limited liability company ("Sewer Cleaning Company," "we," "us," or "our"). They govern your use of the website located at sewercleaningcompany.com, any other website or web page we operate that links to these Terms, and the forms, scheduling and payment tools, chat features, text message programs, and other online features offered through them (together, the "Site").

By using the Site, submitting a form, or opting in to our text messages, you accept these Terms and our Privacy Policy, available at https://sewercleaningcompany.com/privacy-policy/, which is part of these Terms. If you do not agree, do not use the Site.

Sections 13 and 14 limit our warranties and liability for the Site, and Section 19 explains where disputes about the Site are decided. Please read them.

1. What These Terms Cover

1.1 Website use only. These Terms govern the Site. They do not govern the plumbing, sewer, drain, excavation, waterproofing, inspection, or related services we perform. Those services are governed by the estimate, work order, service agreement, invoice, or warranty you receive when you hire us (the "Service Documents"). If these Terms and a Service Document conflict about services we perform, the Service Document controls.

1.2 Privacy Policy. Our Privacy Policy explains what information we collect through the Site and in the course of providing services, how we use and share it, the cookies, analytics, and advertising technologies we use or may use, and the choices you have, including how to opt out of interest-based advertising. Our privacy commitments for text messaging are in Section 6 of our Privacy Policy.

1.3 Consumer rights preserved. Nothing in these Terms limits any right you have under the Ohio Consumer Sales Practices Act or any other law that cannot be waived by agreement.

2. Emergencies

The Site is not monitored in real time, and a web form, chat message, email, or text message is not a reliable way to reach us in an emergency. If you have a sewage backup, active flooding, a burst pipe, or another urgent plumbing or sewer problem, call us at 440-290-6055. We answer calls 24 hours a day, 7 days a week. If you smell gas, suspect a gas leak, or face any threat to life or safety, leave the area and call 911 and your gas utility before contacting us.

3. Who May Use the Site

You must be at least 18 years old to submit a service request, schedule or pay for service, opt in to text messages, or apply for a job through the Site. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. See Section 12 of our Privacy Policy.

4. Our Service Area and Site Content

4.1 Service area. We serve residential and commercial customers in Northeast Ohio, including Cuyahoga, Geauga, Lake, Lorain, Medina, Portage, and Summit Counties. Availability of a particular service at a particular property depends on site conditions, access, permits, local codes, and scheduling.

4.2 Availability. Our 24/7 availability means we take calls and dispatch around the clock. Response times vary with demand, weather, distance, and the nature of the problem.

4.3 Photos and descriptions. Photos and videos on the Site may show prior jobs, equipment, or stock imagery and are for illustration. Service descriptions are general summaries. The scope of work for your property is set out in your Service Documents.

5. Information, Not Professional Advice

Content on the Site, including service descriptions, blog posts, videos, FAQs, and chat responses, is general information. It is not a diagnosis of your plumbing or sewer system, a repair instruction, or a substitute for an on-site evaluation by a qualified professional. Do not attempt sewer, plumbing, or excavation work based on Site content. Before any digging on your property, call 811 (Ohio Utilities Protection Service) to have underground utilities marked, as Ohio law requires.

6. Quotes, Estimates, Pricing, and Promotions

6.1 Estimates are approximate. Any price, quote, or estimate shown on the Site or provided in response to a Site inquiry is approximate and based on the information you provide. Final pricing depends on an on-site evaluation of the actual conditions, the scope of work, permits, and the materials and equipment required.

6.2 When pricing becomes binding. A quote is not a binding offer until we confirm it in a written estimate, work order, or service agreement, which may be delivered and accepted electronically. Written and oral estimates given at the time of service are governed by your Service Documents and applicable Ohio law.

6.3 Promotions and coupons. If we publish a coupon, discount, or promotion on the Site or send one to you by email or text: it must be mentioned before work begins; it applies only to the services described in the offer; one promotion may be used per visit unless the offer says otherwise; it cannot be combined with other offers or applied to prior invoices; it has no cash value; and it expires on the date stated or, if no date is stated, when we remove it from the Site. We may modify or withdraw a promotion at any time, but we will honor a promotion that has already been applied to a confirmed written estimate.

6.4 Financing. If we make third-party financing available, the lender decides whether to extend credit and on what terms. The lender's agreement and privacy policy govern your financing, and we do not guarantee approval.

7. Service Requests, Online Tools, and Communications

7.1 Accurate information. When you submit a request, booking, payment, or message through the Site, you agree to provide accurate and current information and to update it if it changes.

7.2 Authority to request work. By requesting service at a property, you represent that you own the property or are authorized by the owner or property manager to request work there and to give us access.

7.3 How we may contact you. When you submit a request or booking, you authorize us to contact you by phone, email, and text message about that request, including to schedule, confirm, and follow up on service. Calls with us may be recorded or monitored, and phone numbers on the Site may be call-tracking numbers, as described in Section 8 of our Privacy Policy. Marketing text messages are sent only with the separate consent described in Section 8 of these Terms.

7.4 Electronic communications. You agree that we may provide estimates, work orders, invoices, receipts, notices, and other communications to you electronically, by email, text message, or through the Site, and that electronic communications satisfy any legal requirement that a communication be in writing. To receive them you need a device with internet or mobile service and a working email address or mobile number. You may request a paper copy of any document, or withdraw your consent to electronic communications, by contacting us at the address in Section 21. Withdrawing consent may delay scheduling or documentation of your service.

7.5 Online scheduling. If the Site lets you request an appointment online, your request is a request only. An appointment is confirmed when we confirm it by text, email, or phone. Appointment windows are estimates, and emergency work may require us to reschedule. Tell us as early as possible if you need to cancel or move an appointment.

7.6 Online payments. If the Site lets you pay an estimate, deposit, or invoice online, payments are processed by a third-party payment processor under its own terms and privacy policy, and we do not store your full card number on our systems. By submitting a payment you authorize the charge shown, represent that you are authorized to use the payment method, and agree to receive your receipt electronically. Questions about the work behind an invoice are handled under your Service Documents; contact us before disputing a charge with your card issuer so we can resolve it.

7.7 Chat features. If the Site offers a chat feature, it may be answered by automated software (a virtual assistant) or by our staff, and we will identify automated responses when you ask. Chat is for general questions and scheduling. It cannot diagnose your system, and it is not for emergencies (Section 2). Chat transcripts are handled as described in the Privacy Policy.

8. Text Message (SMS) Program Terms

8.1 Our text programs. Sewer Cleaning Company offers two text message programs:

1. Service Messages: messages about a service inquiry or job, such as confirmations, scheduling and technician arrival updates, estimates, invoices and payment reminders, follow-ups on work performed, and requests for feedback about your service.
2. Marketing Messages: promotional messages, such as offers, seasonal maintenance reminders, and news about our services.

8.2 How you opt in. You opt in to Service Messages by checking the text message consent box on one of our forms, by texting us at 440-290-6055, or by asking us to text you about your service. You opt in to Marketing Messages only by giving separate consent, such as checking a separate, clearly labeled marketing box on a form or texting a keyword we publish for that purpose. Consent to receive Marketing Messages is not a condition of purchasing any goods or services from us.

8.3 What you agree to. By opting in, you give your express consent (and, for Marketing Messages, your prior express written consent) to receive recurring text messages from Sewer Cleaning Company at the mobile number you provide, which may be sent using automated technology. You confirm that you are the subscriber or customary user of that number and are at least 18 years old.

8.4 Frequency and cost. Message frequency varies depending on your service activity and, for Marketing Messages, on the offers we send. Message and data rates may apply. Contact your carrier for details about your plan. Carriers are not liable for delayed or undelivered messages.

8.5 How to opt out. Reply STOP to any text message from us at any time. We will send one message confirming your opt-out and then stop texting you. A STOP reply stops all text messages from us unless you tell us you want to stop only one program; if you are enrolled in both programs, we may send one message asking which you meant, and if you do not reply we will stop all texts. You may also opt out by any other reasonable method, including calling 440-290-6055 or emailing assist@sewercleaningcompany.com. We honor opt-out requests promptly and no later than 10 business days after we receive them. Opting out of texts does not stop us from responding to your service requests by phone or email.

8.6 Help. Reply HELP to any message, call 440-290-6055, or email assist@sewercleaningcompany.com for assistance.

8.7 Supported carriers. Our messages are compatible with major U.S. carriers. Not all carriers are supported, and delivery is not guaranteed.

8.8 Your number. If you change, give up, or deactivate the mobile number you provided, notify us so that we do not text the new holder of that number.

8.9 Privacy of your mobile information. Mobile phone numbers and opt-in information collected for text messaging will not be shared with third parties or affiliates for marketing or promotional purposes, and we never use them to build advertising audiences. Section 6 of our Privacy Policy describes how we handle text messaging data.

9. Content You Send Us

9.1 What this covers. You may send us photos, videos, descriptions of a problem, messages, chat transcripts, reviews, testimonials, and job application materials ("Your Content").

9.2 License. You keep ownership of Your Content. You grant us a non-exclusive, royalty-free license to use, copy, store, and share Your Content as needed to evaluate and perform services, respond to you, keep business records, train our staff, and improve our services. We will not use your name, likeness, or images of your property in advertising without your permission.

9.3 Your responsibilities. You represent that you have the right to send us Your Content and that it does not violate any law or the rights of any person.

9.4 Reviews and testimonials. Honest reviews are welcome. Nothing in these Terms restricts your right to post truthful reviews of our services on any platform. Testimonials on the Site reflect the experience of the individual customer; results and pricing for your property may differ.

9.5 Suggestions. If you send us ideas or suggestions about the Site or our services, we may use them without any obligation to you.

9.6 Job applications. Information you submit through our Careers page is used to evaluate you for employment, as described in Section 13 of our Privacy Policy. Submitting an application does not create an offer of employment. Sewer Cleaning Company is an equal opportunity employer.

10. Intellectual Property

The Site and its content, including text, graphics, logos, photos, videos, page design, and software, are owned by Sewer Cleaning Company or its licensors and are protected by copyright, trademark, and other laws. The Sewer Cleaning Company name and logo are our trademarks. Third-party names and logos appearing on the Site (such as NASSCO) belong to their owners. You may view, download, and print pages of the Site for your personal, non-commercial use. You may not copy, reproduce, republish, distribute, sell, or create derivative works from Site content for any commercial purpose without our prior written permission. To report content you believe infringes your copyright, email assist@sewercleaningcompany.com with the location of the material and your contact information.

11. Acceptable Use

You agree not to:

1. use the Site for any unlawful purpose or in violation of these Terms;
2. attempt to gain unauthorized access to the Site, its forms, its hosting systems, or any related network or account;
3. introduce viruses, malware, or other harmful code, or interfere with the security or operation of the Site;
4. use bots, scrapers, or other automated means to access the Site or collect content or data from it, including to train artificial intelligence systems, without our written permission;
5. submit false information, impersonate any person or business, or use our forms or chat to send spam, solicitations, or unsolicited advertising; or
6. remove or alter any copyright, trademark, or other proprietary notice.

We may limit, suspend, or block access to the Site by anyone we reasonably believe has violated these Terms.

12. Third-Party Websites, Services, and Advertising Technology

The Site links to third-party websites and services, including review platforms, social media pages, Google Maps, and trade associations, for your convenience. Some Site features, such as forms, scheduling, chat, texting, call tracking, video hosting, and payment processing, are operated with third-party service providers. The Site also uses, or may use, analytics and advertising technologies from companies such as Google and Meta, described in Section 5 of our Privacy Policy, where you can also find your choices; the Your Privacy Choices page lists the technologies active at any given time. We do not control third-party websites and are not responsible for their content, accuracy, availability, or privacy practices. Your use of a third-party website or platform is governed by its own terms and privacy policy.

13. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT SITE CONTENT IS COMPLETE OR CURRENT.

THIS SECTION APPLIES TO THE SITE ONLY. IT DOES NOT LIMIT ANY WARRANTY WE PROVIDE ON SERVICES WE PERFORM, WHICH IS GOVERNED BY YOUR SERVICE DOCUMENTS, AND IT DOES NOT LIMIT ANY WARRANTY OR RIGHT THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEWER CLEANING COMPANY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THIS SECTION APPLIES TO THE SITE ONLY. IT DOES NOT LIMIT OUR LIABILITY FOR SERVICES WE PERFORM, WHICH IS GOVERNED BY YOUR SERVICE DOCUMENTS AND APPLICABLE LAW. NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD.

15. Indemnification

You agree to indemnify and hold harmless Sewer Cleaning Company and its members, managers, officers, employees, contractors, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your misuse of the Site.

16. Accessibility

We want the Site to be usable by everyone, including people with disabilities, and we use the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, as our standard as we maintain and update the Site. If you have difficulty using any part of the Site or need information in an alternative format, call 440-290-6055 (available 24/7) or email assist@sewercleaningcompany.com, and we will work with you to provide the information or service you need.

17. Changes to the Site or These Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. When we do, we will post the updated Terms on the Site and change the Effective Date at the top. If a change materially affects the text message programs in Section 8, we will also notify enrolled subscribers by text or email. Your continued use of the Site after the Effective Date of an update means you accept the updated Terms.

18. Termination

We may suspend or terminate your access to the Site at any time for violating these Terms or to protect the Site, our customers, or our business. Sections 9, 10, and 13 through 20 survive termination.

19. Governing Law and Disputes

19.1 Ohio law. These Terms and any dispute about the Site are governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-laws rules.

19.2 Talk to us first. If you have a dispute about the Site, contact us at the address in Section 21 with a description of the problem. We will try to resolve it with you informally within 30 days.

19.3 Courts. Any dispute about these Terms or the Site that is not resolved informally will be brought exclusively in the state courts located in Lake County, Ohio, or the United States District Court for the Northern District of Ohio, and you consent to personal jurisdiction and venue in those courts.

19.4 Services. Disputes about services we perform are governed by your Service Documents and applicable law, not by this Section.

20. General Terms

20.1 Entire agreement. These Terms, together with the Privacy Policy and the text message program terms in Section 8, are the entire agreement between you and us about use of the Site.

20.2 Severability. If any provision of these Terms is found unenforceable, it will be enforced to the extent permitted, and the remaining provisions remain in effect.

20.3 No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.

20.4 Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of our business or assets.

20.5 No third-party beneficiaries. These Terms do not give rights to anyone other than you and us.

20.6 Headings. Headings are for convenience only and do not affect interpretation.
